Historic Verdict in Delhi

The outcome of Delhi Assembly elections heralds the arrival of a new force in Indian politics. It reaffirms the widely felt disenchantment and disgust with the ruling UPA regime. The decimation of the ruling Congress party shows beyond doubt that there is yearning for change. Yet the inability of the BJP to secure a majority shows that the voters who want change are not satisfied with a mere substitute. The spectacular debut of the Aam Aadmi Party (AAP) demonstrates that the aam aadmi of India is willing to trust alternative politics.

AAP’s performance in the Delhi elections is by far the most spectacular political debut in the last three decades. This barely one year old political party has achieved this amazing feat in the face of the collective might of the two big parties evident in their money and muscle power and slander campaign launched by vested interests and supported by a section of the media. But for this concerted campaign, AAP could well have obtained a clear majority in Delhi assembly. Its final tally thus under-estimates the extent of popular support for the party.

Aam Aadmi Party’s success goes beyond the simple count of votes and seats. The real significance of the rise of AAP lies in the challenge that it has posed to the established ways of the politics. With its roots in the most extraordinary anti-corruption movement of this country, AAP has turned this into a battle against the corrupt political system. It offered a systemic alternative by way of radical political decentralisation. AAP’s election campaign set a model for financial and political transparency. For the first time in the history of the country a political party collected “white money” for politics, made full disclosure of all donations received, met the target that it had set and refused to take any more donations. Perhaps for the first time, a political party withdrew support to its official candidate purely on moral grounds, as the AAP did in Rajouri Garden. For the first time, a political party issued manifestos for every single constituency. AAP broke away from the politics of caste and community vote banks and revived the culture of door to door canvassing. The record turnout in this assembly election and the popular support for a new political outfit bears ample testimony to the public response to this new political begining.

The credit for this extraordinary feat must rest with thousands of volunteers who worked tirelessly in this campaign. In sharp contrast to the dominant culture of paid workers, these volunteers from within and outside Delhi and indeed, Indians residing outside the country sacrificed their career and comfort in the service of this larger cause. Their dedication and idealism brought back the voluntary spirit of politics. AAP salutes the spirit of these volunteers.
This historic vote places enormous responsibility on the AAP. We wish to assure the citizens of Delhi that AAP shall not take part in any political wheeling-dealing that might ensue following this “hung verdict”. We have made a solemn promise to the voters of Delhi that we shall neither seek nor offer support to any part of the corrupt political establishment of the country. We wish to reiterate that the Delhi election is only the first step in our political journey. We are here to challenge the political establishment throughout the country. Our next mission would be to offer a genuine political alternative in the Lok Sabha elections 2014.

AAP rewrote the rules of the game

Aam Aadmi Party's victory is the victory of belief in general goodness in the times of cynicism. We have heard stories about how it's caste equations that matter. We have been told too many times it's the money and the muscle that matter, honesty and transparency don't. We were persuaded by naysayers who said politics is not a place for good people. And our electoral history is littered with examples of good people standing up only to be defeated. Examples that dissuaded other good people from coming forward. And then the mass AAP rising in Delhi turned that conventional wisdom on its head. And here's what matters.

1. COURAGE MATTERS
Shivraj Singh has won Madhya Pradesh very convincingly. He won the state on the basis of his performance. All the pre-poll surveys said he was invincible. Yet he contested from two seats. His home Budhni and Vidisha. Because what if he lost his own seat was a question too important to ignore. In contrast, Arvind Kejriwal was a first timer from a first-timer party. He had announced he would contest against Sheila Dikshit, the giant of a Congress leader who not only herself but won her party power in Delhi for three consecutive terms. Arvind did not fear her. He too had the option to contest from an additional seat, a safer seat. What if the leader lost? Well there are no What-Ifs in a courageous man's mind. And people respect that.

2. PRINCIPLES MATTER
Both Congress and BJP talk a lot about probity in public life and how one is better than the other. But when it comes to elections, they don't give two hoots to probity. Winnability is all that matters. Well, Arvind Kejriwal just proved that wrong. He promised not to give tickets to any candidate with a tainted past. He succeeded till a couple of black sheep emerged. The moment the party was convinced of the taint, he withdrew his support. In what could be outrageous for other parties, he removed a candidate just four days before polling. Because Aam Aadmi Party cared for the principles it espoused.

3. HONESTY MATTERS
Arvind Kejriwal and his party members were targets of various public and private investigations. In fact, there was an attempt to make them look like just another party. Anna Hazare came out of his Ralegan Siddhi home to cast doubt on AAP's integrity. Arvind was undeterred and kept offering evidence to prove his was an honest and transparent party. Shazia Ilmi, who lost by a very thin margin, withdrew her candidature when she was caught on tape accepting she would accept money. She came back in the fray only when the tapes were found to be edited to frame her. People saw it all. And backed AAP. Because honesty matters.

4. YOUTH MATTERS
While most political parties pay lip service to youth, they don't offer tickets to them. Mostly because they think politics is a game of intrigue that only the veterans understand.  In case they give out tickets to the youth, the veterans did not give up the controls. They decided how to run the campaign and often they dominated the campaign. The fresh face was just showcased, while the body bore clear marks of old age. Arvind Kejriwal, thanks to the fledgling nature of his party, did not have that what we can call luxury. He had to give it all to whoever he chose. He valued the young supporters as much as the 'youth' candidates. The result is for all to see. The youngest member of the Delhi Assembly will be only 25. And there are many more. Others said youth mattered. Arvind Kejriwal showed them how.

5. PEOPLE MATTER
And finally, while both the Congress and the BJP talk about pro-people policies the people have seen through their talk. Corruption as an issue was written off summarily by the Congress. BJP did not write it off but used it for convenience. It was forced to choose Harshvardhan because it just could not be as blunt as the ruling Congress. Arvind Kejriwal made corruption the biggest issue. He made expensive electricity an issue. He made civic amenities an issue. Because these were people issues. Assembly elections are not fought on Rahul vs Modi issue, but people vs the system issue. BJP, the bigger and the older, was supposed to lead the narrative but ended up following the younger and the bolder AAP.

14,000 families being forcefully evacuated by Shirke Constructions without due process of law.

In the last few decades MHADA allowed 14,000 families to buy tenancy rights in Transit Camps and allowed them to enjoy all the rights of entitled transit allottees.

Now MHADA has entered into exclusive redevelopment contracts with Shirke Construction in almost all the camps, without any tendering or bidding. Shirke is allegedly very close to Sharad Pawar and Prithviraj Chavan and hence enjoys an undisputed monpoly in
MHADA contracts.

In collusion with MHADA, Shirke is now throwing out these 14,000 families without going through any process of law. A notice is shoved through a door or window and in less than 48 hours the demolition begins! While some still occupy the houses, some have been thrown out and for some unfortunate others their houses have already been demolished. These are poor houses, in pathetic conditions, some in buildings and some in chawls, not very different from slums. These trapped people are not against the redevelopment, they are not even demanding free homes! All they are asking for is due notice period and the right to buy a home in the new project at ready reckoner prices!!

These people approached Aam Aadmi Party and after understanding that all they were asking for was the right to buy a home, Anjali Damania began talks with MHADA officials. Her first meeting was with the Chief Legal Adviser Shri CM Vachasunder and Shri Surawade, DE Transit. The next meeting was with CEO Mumbai Board Shri. N Sudhanshu (I.A.S) and CEO Repair Board CEO Thombre. The third meeting was with CEO Repair Board CEO Thombre, Shri Surawade, DE Transit and representatives of the legal department.

On behalf of these residents she asked for due notice for evacuation, cessation of demolition in the rains and their right to buy homes in the new development. MHADA makes houses for the needy of Mumbai and these people surely fall in that category. MHADA’s argument is that they only allot by lottery system. Anjali Damania suggested that they could reserve some flats for these people says 25% and sell the rest 75% on lottery - these exceptions have been made in the past. But MHADA officials seem pretty helpless in taking decisions.

While the talks continued on one side, illegal demolitions continued on the other. Many a time things came to a flashpoint between the residents and the demolition crew of Shirke Constructions. On 27th June Anjali met Minister of State of Housing, Slum Improvement Shri Sachin Ahir and he was not averse to this proposition but said it was in the Chief Minister’s purview to take a call. Despite repeated attempts, AAP has been unable to get an appointment with the Chief Minister; hence Anjali Damania led 400 residents to Mantralaya to at 11am on 28 June to meet the CM. Needless to say all have been arrested and detained at Marine Drive Police Station. Anjali has said she and the protestors will not take bail or leave the police station until the CM agrees to meet and resolve this issue. Talks are on that it is likely that the CM and MHADA officials will meet Anjali and the residents later today.

The History
Since 1972, 56 transit camps were made in Mumbai which house 22,500 families. Out of the 22,500 families, approximately 14,000 families who were originally allotted the homes, sold and alienated their rights in of their respective premises in favour of third parties - the purchasers. MHADA offices transferred the respective flats in the name of such third parties. All the 14,000 occupants have been paying rent to MHADA and have duly received rent receipts in respect thereof. However, since 2010 MHADA started showing the consideration received as “Services Charges”. All the 14,000 occupant families have documents like voters’ card, electric bills, birth certificates, ration cards and various documents since years to prove their credentials.

Now, decades later MHADA says its officers were wrong in allowing the transfer of tenancy right. But MHADA is represented through its officers and therefore all acts of its officers are deemed to be acts of MHADA. If at all MHADA has a remedy against the wrongs, it is only against its own officers for breach of trust and duty, and against these families. If these people wished they could battle with MHADA for rights paripasu of original allottees but all they are asking for is due notice period and the right to buy a home in the new construction.This will ensure that MHADA does not loose the revenue despite the wrongs of its own officials. And on the other hand it will ensure that the victims of the corrupt MHADA officials are provided with the opportunity to buy affordable homes.

Yesterday many of our volunteers were brutally beaten up by the Delhi police for protesting outside the police station asking for the police to register an FIR in the case of a  young woman who was confined and raped for 2 days in Gokulpuri.  The picture shows the viciousness of the attack on peacefully protesting young men and women.  Several of them were admitted to the hospital with broken bones and bleeding wounds.  When one of our volunteers asked for water, he was offered urine.  (Read the news report in 'The Hindu')


Volunteers are our strength and when the police beats up any one of us, each lathi, each blow is a pain inflicted on all of us. Gandhiji’s freedom fighters had to endure the same brutality at the hands of the British rulers. Little did we know that this unjust treatment would continue even after we got independence and this time at the hands of our own elected government.  This dictatorship in a so called democracy has to stop.  This is what the Aam Admi party is fighting for as we wage India's second battle for independence.
Friends, let us send a strong message to all those who seek to silence the voice of the aam aadmi, that we are all united and will not allow people’s right to expression and protest to be trampled upon with such disdain. We demand justice for the violence victims and stringent action on policemen who were involved in this brutal attack on civilians. Please take one or more actions listed below:

When People are trying to demonstrate to file FIR, they are beaten up, lathi charged, when asked for water they are offered urine. Its really #jungleraj. I think There is no difference between British raj in 1900 and NOW, Some one need to be Bhagat Singh, Khudiram Bose, Subash chandra Bose.

Extremely angered after reading the tweets from Arvind Kejriwal.

A newly married woman was gang-raped in the rape capital of our country (Delhi). She approached Aam Aadmi Party - Delhi. AAP volunteers immediately rushed to help her.

Delhi police were back to their old attitude & refused to register an FIR. But, were compelled to register the FIR by the AAP volunteers who then had to face the wrath of the Delhi police.

15 of the volunteers were arrested & later presented before the magistrate. The state in which the volunteers were brought was SHOCKING. They had been beaten mercilessly. The volunteers said that police kept saying - "Aam Aadmi Party se ho, ye lo, aur lo". It seems police was taking out some kind of revenge.

When they asked for WATER, CAN U BELIEVE...... they were given URINE......Their hands and legs were broken.. with plasters & with several wounds on their bodies. Some of them could not even walk and had to be lifted bodily to be presented before the magistrate.

What was their crime ???? They all had gone to the police station ONLY to demand FIR in a gang rape case.

Arvindji has tweeted :

** If police or govt thinks they can threaten us or stop us like this, they are mistaken. This has further strengthened our resolve.

Today if we do not see Arnab Goswami / Rajdeep Sardesai / Rahul Kanwal / Nikhil Wagle / Rajiv Khandekar / Uday Nirgudkar taking this issue big time. They are NOT fighting for the cause, for the country, for the citizens.

If they don't cover this......I will assume that......

* They don't care for a rape / Gang rape. They talk about it just when they have some extra time

or

* It is NOT being taken up because they have been directed NOT TO COVER Aam Aadmi Party volunteers.

* Those stupid volunteers who have made the blunder of fighting for the country.
* Those idiots who have a dream of changing their country & make it a better place to live in.
* Those silly people who have defied the system by putting their life at stake, their jobs at stake, their family at stake.
* Media cares only and only for TRP & for their balance sheets which are likely to swell as we go close to 2014 (if they don't cover AAP).

I am really upset, agitated & feeling helpless. How do I live in a country where poor are looted and yet helpless. Where politicians are goons yet protected, where police are corrupt & ruthless, where media is existing and yet selectively covering only the mighty and most importantly where ........ The ELITE citizens of my country care a damn for the country & want their children to go to US / UK and never come back.

I was not Wrong In 2009.....

When I was looking at my older mails, I came across a mail written by me to the JNM team ( Mayank Gandhi, Adolf, Praful bhai and others ) way back in Feb 2009. As lok sabha election was approaching in May 2009, Few concerned citizen (Group) are thinking of political intervention.
Let me tell you about JNM (http://www.facebook.com/JNMmumbai), It is an NGO for alternative politics. JNM have filled citizen candidate for Mumbai corporation election and has won JUHU corporation election. The concept is based on Swaraj.
Coming back to the point of political intervention in 2009 election, JNM has put an idea of making a survey. The message I got is


There are number of organizations and new political parties that want to field or support candidates for the forthcoming Lok Sabha Elections. JNM as a civil society movement would like to invite volunteers to conduct the Opinion Poll for the last day.
 Please volunteers along with your friends on Saturday, the 21st Feb, 2009 from 11.00 am to 2.00 pm, at either of the following places:
1)      Churchgate - meeting place outside Government Law College (A Road)
2)      Andheri (W) - opposite Station
 The volunteers will be divided into groups of 5, each team will be handed a placard saying:
 In the coming MP Elections who will you vote for:
Existing Political Party ( Cong / BJP / NCP / SS / MNS, etc )
OR
New Party ( Loksatta Party, PPI, Jago Party, BRSP, etc. )
OR
Citizens' Candidate ( selected by NGO/citizens groups, etc. )

                 Practically speaking,   I can say most of the people will say 3rd option. Because there is no use of giving the 2nd option as most of the people dont know about these parties. And people will say NO to existing one. Obviously 3rd option will get majority.
THE  NEW POLITICAL PARTIES ARE NOT AS THAT OF EXISTING POLITICAL PARTIES BUT THEY ARE POLITICAL PARTY .AND IN POLITICS POLITICAL PARTIES ARE REQUIRED .

Today in 2013, I realized that I was not wrong in basic thinking that we need political party for fighting election. Independent fighting of election is not going to serve the purpose. In todays scenario AAP and LokSatta are the only 2 parties that I think we should join and be a part of the system to change the system..

What are the implication of Arvind Kejriwal contesting against Sheila Dikshit?

Arvind Kejriwal announced on June 2nd 2013 that he will contest against Delhi chief minister Sheila Dikshit in the Delhi assembly polls. Arvind launched his political party AAP ( Aam Aadmi Party) in 2012. AAP will be contesting on all seats for Delhi Assembly elections 2013.
What do you think would be the impact of him contesting against Sheila, the current CM of Delhi?

his is just another step to change the ways in which politics is done in India. Right now, on a sure shot seat, the opposition parties don't even attempt to fight. There was no candidature against Dimpy Yadav's (Daughter in Law of Mulayam Singh Yadav) MLA elections in Kannauj. No party contested the recent Rajya sabha polls in Assam against the PM Manmohan Singh. Is this a silent (or may be expressed) understanding among the parties? Are they hand in hand in looting the masses??......

won the Ramon Magsaysay Award for Emergent Leadership in 2006 for his contribution to the enactment of the Right to Information Act,2005 and for activating India's Right to Information Act and bringing it two action.

Arvind Kejriwal has nothing to lose. He has done his bit to wake up the people and make a call for change. If people do not respond now when Sheila Dikshit has failed so miserably over everything, when will they respond.
You don't need a mathematician to tell you that there are two possibilities:
1. Kejriwal Loses and 2. He wins. Let us see both scenarios:

Kejriwal loses:

Short answer: AAP is still a budding party. Parliamant Elections are due in 2014. and they shouldn't lose their immense follower base on these minor elections (in the frame of national politics). All the clamor of bringing change would die as soon as he loses his seat in Assembly election. Kejriwal losing the Assembly Elections would mean blow to the party in nascent stage, a severe blow that will take a long time to heal.
Long answer:
  1. Enthusiasm of party workers and root level supporters will drastically fall and this will be a huge blow to the party before the much hyped 2014 election.
  2. The statistics will take a serious hit. Imagine how would political gurus and analysts react when the huge supporter base that AAP claims will fall flat against the Delhi queen! Kejriwal and AAP will lose credibility.
    "AAP sub hawa hai!" Translate: AAP is too superfluous to trust.
  3. Also, remember that election results are heavily influenced by the swing votes. If Kejriwal, the man himself loses in Delhi Assembly Elections, his image will be in serious problem. Also AAP will heavily lose funds and sponsorship. There is high likelihood that it will become financially too weak to even contest the 2014 battle. Remember, money plays and important role in campaigning (not to buy votes but by campaigning/organizing events in various constituencies)
  4. More so, If Kejriwal loses in Delhi Assembly Elections and yet goes on to contest in 2014, he will be damned as the type of person who is too insisting to win, a difficult-to-put down contestant. Remember, this is precisely why people hate Modi, he just wouldn't let it go. Unlike Kejriwal, Modi has a strong performance record and therefore, can afford the hatred of selected few.

Kejriwal wins:
  1. Now lets imagine a fictitious scenario that AAP invests all its funds in one seat and the night before the election, the genie grants Kejriwal a wish and Kejriwal wins. Voila moment! He still can't make a govt in Delhi single handedly. Worse, he might just interfere in the proceedings of government in every way possible to vent out his frustration and obviously to register his genuine protest. The fact is HE STILL CAN"T MAKE A DIFFERENCE or BRING IN THE CHANGE! Worse, he will gain a new section of haters.
  2. Now if he wants to contest 2014 election, he will have to leave his seat in Delhi Assembly, thereby losing credibility of people in his constituency. He will be shamed for being fickle mindedness and AAP will be blamed for suffering leadership crisis much like Congress is blamed for supporting only THE family.

What he should have done instead?

I strongly believe that Delhi Assembly was the perfect time to bring in and introduce new faces in the central scene. Kejriwal is trying to lead the party himself on all fronts. He has to tell and persuade his followers that he trusts them with bigger responsibilities. By introducing new faces, he would have gained the trust and respect of both political workers and swing voters. By being true to the name, AAM AADMI PARTY, he would have gained respect and publicity.
Not that they would win, but their stronghold in Delhi for 2014 would have been a little stronger. Now I am not saying, AAP's candidate has to be Kejriwal's right hand, it could have been any popular contestant of the constituency (a delhi citizen) against Dikshit. AAP needs to put a face on its supporters. When you say BJP you talk Modi, Advani, Sushma, Rajnath, Chouhan, Raje etc. When you say Congress, you talk The Gandhi family, Chidambram, Antony, Sachin Pilot etc.. When you talk AAP you say Kejriwal and end of story...

Elections are not won by sentiments, they are won by strategies. There is a reason why there are only two national parties in India and pretty much only 1 before 1990s.

Also, let me make it clear AAP has no present tense, it is just the future they are building. Their immediate concern should be to have respectable candidates to lead at least 60-80 constituencies in 2014 from the front and win at least 50% of them. Make strategies sooner, decisions faster and results will definitely be better.

None can form a party, win elections and become PM in matter of 3 years. Not Mahatma Gandhi, not Nehru, not Vallabh bhai Patel. Well, actually only Rahul Gandhi and Sir Ravindra Jadega can! :P

This is going to be Make or Break for AAP. Contesting from Delhi which is stronghold of congress is similar to David vs Goliath.
Congress can gear up to all bad means to crush AAP. Because crushing AAP especially Kejriwal will be a crushing AAP forever and be a symbolic win for Congress. And they can prove the rest of the country that Anti Curruption movement will not affect them for General Elections of 2014.

I know AAP will win if there is FAIR elections.But I strongly doubt given so much is at stake for UPA in this election and Delhi being right there proximity wise they will have all means possible to divert the results towards them.

Very Inspiring Story

98 year old Dobri Dobrev, a man who lost most of his hearing in the second world war, has traveled 25 kilometers every day for decades from his village in his homemade clothes and leather shoes to the city of sofia - a trip he made by foot until recently - where he spends the day begging for money. 

Though a well recognized fixture around several of the city’s churches, known for his prostrations of thanks to all donors, it was only recently discovered that he has donated every penny he has collected — over 40,000 Euros (~ $52,000) — towards the restoration of decaying Bulgarian monasteries and churches and the utility bills of orphanages. He is living entirely off his monthly state pension of 80 euros and the kindness of others.

Press Note - 4th June - Political Parties brought under RTI

Press Release: Political Parties brought under RTI Act; 
Full Bench CIC directs them to provide information under RTI.           


       
New Delhi, 4th  June 2013

On 3rd of June 2013, a full bench of Central Information Commission (CIC) comprising of Chief Information Commissioner Shri. Satyananda Mishra and Information Commissioners Shri. M.L. Sharma and Smt. Annapurna Dixit gave a landmark judgment where they ruled in favor of bringing Political Parties under the ambit of Right to Information Act (RTI).
In October 2010, Association for Democratic Reforms (ADR) filed RTIs with various National Political Parties seeking information regarding the contributions (donations) that were received by them. In response to these RTIs all National Political Parties, barring CPI, refused to divulge any information by putting forth the alibi that they didn’t come under RTI. Following this a complaint (CIC/SM/C/2011/000838) was filed with CIC in March 2011 requesting that Political Parties should be declared as public authorities so as to bring them under the purview of RTI. A similar complaint was also filed by Mr. Subhash Chandra Agrawal (CIC/SM/C/2011/001386). In both the complaints, the common issue relating to the disclosure of the accounts and funding of Political Parties was raised. Hence, it was decided by the CIC to dispose of these matters through a common order.
The historic judgment pronounced by the aforesaid bench of CIC primarily laid out arguments of three fundamental natures, those the bench found instrumental in arriving at the judgment.  These three critical and adequately reasoned out arguments are:
The Order and the supporting Arguments

The salient features of the operative part of the CIC order are as follows:

a)      Political Parties are Substantially Financed by the Central Government: INC, BJP, CPI (M), CPI, NCP and BSP have been substantially financed by the Central Government under section 2(h) (ii) of the RTI Act.

i.        Allotment of land in DelhiIndirect Financing of Political Parties by Allotment of large tracts of land to them in prime areas of Delhi either, free of cost, or at concessional rates.
ii.      Allotment of land in State Capitals: Allotments of land to Political Parties in State Capitals as well
iii.    Accommodations/Bungalows at Concessional Rentals: Directorate of Estate has allotted Bungalows to Political Parties in Delhi at highly concessional rates; this is also a form of indirect financing of the Parties.
iv.     Total Tax Exemption: Central Government also provides to Political Parties total exemption from the payment of income tax against the incomes of the Parties (under section 13 A of the Income Tax Act)
v.       Free Airtime on Doordarshan & All India Radio: During Lok Sabha Elections and State Assembly Elections, Political Parties are allotted airtime slots on Doordarshan and All India Radio absolutely free of any charge


b)      Public CharacterThe criticality of the role being played by these Political Parties in our democratic set up and the nature of duties performed by them also point towards their public character, bringing them in the ambit of section 2(h).

i.        The Political Parties are the life blood of our polity:  Elections are contested on party basis. Political Parties affect the lives of citizens, directly or indirectly, in every conceivable way and are continuously engaged in performing public duty.

ii.      Political Parties are the unique institution: Political Parties are essentially political institutions and are non-governmental. Their uniqueness lies in the fact that inspite of being non-governmental, they come to wield directly or indirectly influence on the exercise of governmental power. It would be odd to argue that transparency is good for all State organs but not so good for Political Parties, which, in reality, control all the vital organs of the State.

iii.    Preamble of RTI Act: The preamble of RTI Act aims to create an ‘informed citizenry and to contain corruption and to hold government and their instrumentalities accountable to the governed. Needless to say, Political Parties are important political institutions and can play a critical role in heralding transparency in public life. Political Parties continuously perform public functions which define parameters of governance and socio-economic development in the country.

c)      Constitutional/legal provisions
Political Parties have constitutional and legal rights-and-liabilities because of the following

               i.      Registration of Political Parties: Political Parties are required to be registered with the ECI under section 29A of the R.P. Act, 1951 – a Central Legislation. An association or body gets the status of a political party on its registration. ECI awards symbols to Political Parties under the Election Symbols (Reservation and Allotment) Order, 1968, only after registration.
            ii.      Filing of Election Expense and Contributions: The ECI calls for details of expenses made by the Political Parties in the elections. Contributions of the value of Rs. 20,000/- and above received from any person or a Company by a Political Party are required to be intimated to ECI under section 29C of the R.P. Act.
            iii.      ECI superintendence: ECI is vested with the superintendence, direction and control of elections under Article 324 of the Constitution. ECI is also vested with the authority to suspend or withdraw recognition of a political party in certain contingencies.
           iv.      Tenth Schedule of Constitution: Political Parties can recommend disqualification of Members of the House in certain contingencies under the Tenth Schedule


Performance of Public Duty
i.                    Setting up of CPIOsThe Presidents, General/Secretaries of these Political Parties are hereby directed to designate CPIOs and the Appellate Authorities at their headquarters in 06 weeks’ time. The CPIOs so appointed will respond to the RTI applications extracted in this order in 04 weeks’ time.

ii.                   Voluntary DisclosureThe Presidents/General Secretaries of the above mentioned Political Parties are also directed to comply with the provisions of section 4(1) (b) of the RTI Act by way of making voluntary disclosures on the subjects mentioned in the said clause

The Way Ahead

Association for Democratic Reforms (ADR) has already set the process, of bringing all the Political Parties under RTI, in motion by filing the RTIs against all the recognized Political Parties. By following the exactly similar process, the complaints against these Recognized Parties will be filed with the CIC to secure a similar judgement against them as well.

Why is it important for Political Parties to come under RTI?

It is being discussed in the public domain that if Political Parties are already filing Income Tax Returns to Income Tax Department and submitting Annual Contribution (Donation) Reports to ECI, then what other possibly crucial information is needed to be accessed from Political Parties.

a)      The information concerning the donors of the Political Parties, currently parties only disclose information for those sums of money that are over and above Rs. 20,000.

b)      The information pertaining to the suspension of existing members from primary membership or providing membership to new members, currently all this is withheld.

c)       The information regarding the Office Bearers inside the Political Parties and the details of  their elections as in who all contested for various posts, also about periodicity of elections

d)      The criteria of selecting candidates that are fielded by Political Parties in Parliamentary and Assembly elections.

e)      The information about the whole gamut of facilities that Government provides to Political Parties, we could only manage to discover a handful of these facilities

f)       Now after Political Parties are brought under the purview of RTI, they will be required to comply with the provisions of section 4(1)(b) of the RTI Act by way of making voluntary disclosures on the subjects mentioned in the said clause.
g)      In totality, the onus of providing information about the matters related to Political Parties after the said CIC order sets into being lies only and only at the doorsteps of Political Parties  and citizens don’t need to run around accessing this information indirectly from other authorities.

Congress-led UPA Government at the Center for attempting to rush through the Food Security Bill with an eye on general elections. 

Dr. JP pointed out that States like Andhra Pradesh, Tamil Nadu, Madhya Pradesh and Chattisgarh have already been making available food grains to a majority of their populations at the same or less rates than envisaged in the Food Security Bill. Yet, the malnutrition levels in the four States are no less than in other States. MP has 60% children with low birth weight, Chattisgarh 47%, AP 33% and Tamil Nadu 30%. In contrast, Punjab has only 25% and Kerala 23% children with low birth weight, although they do not have food security schemes.  

The very fact that one has to pay a bribe of Rs. 3 lakh in cities in Andhra Pradesh to get a fair price shop allotted underlines that the public distribution system is merely lining the pockets of a few but not eradicating poverty.

Dr. JP was addressing media on the occasion of Dr. Mogili Ravi Babu, a dermatologist and cosmetic surgeon belonging to the ST community and his followers, joining the Lok Satta Party. 

Dr. JP said that poverty can be eradicated only if everyone has equal opportunities for growth through quality education, healthcare, skill enhancement and employment.  It cannot be eliminated through slogans and election-eve sops.

Dr. JP said that the well-conceived National Rural Employment Guarantee Scheme has failed to produce the anticipated results. Andhra Pradesh, which has witnessed nearly Rs.23000 crore being spent under the scheme since its inception, would not have been facing an acute water crisis had the scheme been utilized to conserve every drop of rainwater.

Advocating decentralization of power and devolution of resources on local bodies, Dr. JP pointed out that leaders like Mr. Ghulam Nabi Azad viewed the ensuring local elections in Andhra Pradesh as a means to test the Congress strength and not to better people's lives. Had there been genuine decentralization, naxalism would not have flourished and led to instances like the dastardly attack in Chattisgarh. 

Referring to the raging controversy over betting in IPL cricket, Dr. JP asked politicians have no business to dabble in cricket. Like Nero fiddling when Rome was burning, the politicians were indulging in cricket politics instead of focusing on resolving people's burning problems. 

Replying to a question, Dr. JP said that people in elected offices against whom a charge sheet is filed in a court of law should resign forthwith. The Lok Satta has been advocating that they should be debarred even from contesting elections.

On the sacking of Dr. D. L. Ravindra Reddy from the Andhra Pradesh Cabinet, Dr. JP said that in a parliamentary democracy the Cabinet has collective responsibility. Ministers can have differences with the Chief Minister or the Prime Minister but they should discuss them within the Cabinet but not air them in public.  

Unfortunately, the Prime Minister, and the Chief Minister in AP do not  enjoy the freedom to function freely. Had they had the freedom, many of the corruption scams would not have been haunting them now at the national level.

Mr. Katari Srinivasa Rao, State Lok Satta Party President, said that Dr. Ravi Babu and others have chosen to join the party because it is the only party in the country that offers leadership opportunities to all irrespective of their pedigree or wealth or caste. 

Dr. Ravi Babu (36), who obtained his MB&BS from Rangaraya Medical College, Kakinada and MD from Andhra Medical College, Visakhapatnam, has been rendering social service even as he practices as a dermatologist and cosmetic surgeon. He had resigned as Civil Assistant Surgeon before joining the Lok Satta Party.

Indian Political Parties under RTI rules - Central Information Commission

CIC has just delivered this landmark judgment ruling that Political parties should come under the ambit of RTI. Political parties have long resisted opening themselves to public scrutiny.  People have long been demanding that there should be complete transparency in their financial and internal functioning. Various commissions including Law Commission report, Election Commission and NCRCW have already recommended that political parties should demonstrate transparency through various measures. CIC should be immensely complimented for passing this landmark judgement to enable the citizens of India so that they can access information about the Political Parties for which they vote for.
Full bench comprising of Chief Information Commission Shri. Satyananda Mishra, Information Commissioners Shri. M.L. Sharma and Smt. Annapurna Dixit while passing judgement in the complaint filed by Association of Democratic Reforms (ADR) and Subhash Chandra Aggarwal, the hearing for which took place on 26th September 2012 and 1st November 2012, has commented the following-

 “.. we hold that INC, BJP, CPI(M), CPIO, NCP and BSP have been substantially financed by the Central Government under section 2(h)(ii) of the RTI Act. The criticality of the role being played by these Political Parties in our democratic set up and the nature of duties performed by them also point towards their public character, bringing them in the ambit of section 2(h). The constitutional and legal provisions discussed herein above also point towards their character as public authorities. The order of the Single Bench of this Commission in Complaint No. CIC/MISC/2009/0001 and CIC/MISC/2009/0002 is hereby set aside and it is held that AICC/INC, BJP, CPI(M), CPI, NCP and BSP are public authorities under section 2(h) of the RTI Act.”

ADR filed RTIs, seeking information regarding contributions received by the various Political Parties, in October 2010 in response to which except CPI all other political parties refused to disclose information stating that they don’t come under RTI act. Subsequently, a complaint by filed with the CIC in March 2011 requesting that Political Parties should be declared as public authorities.

The bench has further held that
“The Presidents, General/Secretaries of these Political Parties are hereby directed to designate CPIOs and the Appellate Authorities at their headquarters in 06 weeks time. The CPIOs so appointed will respond to the RTI applications extracted in this order in 04 weeks time. Besides, the residents/General Secretaries of the above mentioned Political Parties are also directed to comply with the provisions of section 4(1) (b) of the RTI Act by way of making voluntary disclosures on the subjects mentioned in the said clause.”
